# Terms of Use

These terms govern your use of the TuneSpork application. Installing or using the app means you accept them.

## Licence

Micromosaic Ltd grants you a personal, non-exclusive, non-transferable, revocable licence to use TuneSpork on devices you own or control, in accordance with the usage rules of the store you obtained it from.

The app is licensed, not sold. All rights not expressly granted here are reserved.

Where you obtained the app from the App Store, the licence also covers any other Apple devices you own or control, and accounts associated with you through Family Sharing or volume purchasing.

## Acceptable use

You agree not to:

- Copy, redistribute or sub-licence the app, except as the store’s terms permit
- Reverse engineer, decompile or disassemble it, except where that right cannot lawfully be excluded
- Remove or obscure any proprietary notice it carries
- Use it in any way that breaks the law where you are

## Intellectual property

TuneSpork, its name, its logo, its interface and its underlying software are owned by Micromosaic Ltd and protected by copyright and trade mark law. Nothing in these terms transfers any of that to you.

If a third party claims the app infringes their intellectual property, Micromosaic Ltd — not Apple or Google — is solely responsible for investigating, defending, settling and discharging that claim.

## Purchases

The app is bought through the App Store. Payment and billing are handled by Apple under its own terms; we have no access to your payment details.

## No warranty

The app is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Tuning accuracy depends on your device’s microphone, the acoustics around you and background noise. TuneSpork is a tool for musicians, not a calibrated measuring instrument, and should not be relied on where a certified measurement is required.

## Product claims

Micromosaic Ltd, not Apple or Google, is responsible for addressing any claim you or a third party makes about the app or your use of it. That includes product liability, any failure to meet a legal or regulatory requirement, and claims arising under consumer protection or similar law.

Nothing here reduces the rights the mandatory law of your country gives you.

## Limitation of liability

To the fullest extent the law allows, Micromosaic Ltd is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of or inability to use the app.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

## Third-party terms

You must comply with any third-party terms that apply when you use the app — among them the terms of your mobile data plan, and the terms of the store you obtained it from.

## Export and sanctions

By using the app you confirm that you are not located in a country subject to a United States Government embargo, or designated by the United States Government as a country supporting terrorism, and that you are not listed on any United States Government list of prohibited or restricted parties.

## Consumer rights

If you are a consumer, you keep every right your local law gives you, and nothing in these terms reduces them.

## Apple App Store

Where you obtained the app from the App Store, these terms are between you and Micromosaic Ltd only, not with Apple. Apple has no obligation to provide support or maintenance for the app.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Any claim that the app fails to conform to a warranty may be directed to Apple, which may refund the purchase price; beyond that, Apple has no warranty obligation whatsoever.

## Governing law

These terms are governed by the laws of England and Wales, whose courts have jurisdiction over any dispute — without depriving you of the protection of the mandatory laws of the country where you live.

## Changes

These terms may be updated as the app changes. The current version is always the one on this page, and it took effect on 2026-09-10.
